A New York federal court granted summary judgment to NYU Langone Hospitals on the claims of a Hispanic surgeon of Mexican origin that he faced a hostile work environment due to his race and national origin, in violation of Title VII of the Civil Rights Act and Section 1981, ruling that the surgeon couldn’t demonstrate that he was subjected to severe or pervasive discriminatory behavior, nor could he show that the hospital’s reasons for discharging him was discriminatory or retaliatory pretext.
