A trial court erred when it granted Frank Road Recycling Solutions’ summary judgment motion on the hostile work environment claim of a Black heavy equipment operator terminated after he found a noose in his workspace and later refused to relinquish it to a company co-owner to investigate, where hanging nooses near Black employees historically constitutes racial harassment, and he didn’t have to exhibit multiple instances of racist conduct for his claim to survive, an Ohio appellate court ruled.
