An Indiana federal district court denied General Motors, LLC’s motion to dismiss age discrimination claims brought by the Equal Employment Opportunity Commission under the Age Discrimination in Employment Act, finding that the EEOC plausibly alleged that GM and the International Union, United Automobile, Aerospace and Agricultural Implement Workers of America discriminated against employees aged 66 and older by adopting a supplemental agreement that reduced sickness and accident benefits for those receiving full Social Security retirement benefits, which only applied to older workers.
