A federal district court in Alabama granted Constellium Muscle Shoals LLC’s motion for summary judgment on race discrimination claims under Title VII of the Civil Rights Act and 42 U.S.C. § 1981 of a Black furnace operator who was terminated after committing and failing to report a safety violation while on-the-job. He established a prima facie case of discrimination by citing similarly situated White comparators whom Constellium didn’t terminate despite engaging in similar misconduct, the court said.
