A Pennsylvania federal court denied in part Primex Garden Center’s motion to dismiss 42 U.S.C. § 1981 and state law disparate treatment claims of a White male nursery supervisor suspended and eventually terminated, where allegations that his female Native American manager telling him the company’s plan to move “from ‘the past’”, his belief it pertained to White male issues, and a company owner telling him Whites his age were raised in a different era plausibly allege race and sex discrimination.
