Mid-Hudson Valley Federal Credit Union’s motion for summary judgment on a branch manager’s claims under the Age Discrimination in Employment Act and New York law is denied, a federal district court ruled, where she alleged that an executive didn’t like people over the age of 40, superiors asked her about her retirement plans, the executive used ageist labels for older employees, such as “old as dirt,” raising an inference of discrimination, and the asserted reason for her firing was pretext.
