A Massachusetts court ruled that Setra Systems, Inc. isn’t entitled to summary judgment on a 53-year-old senior director’s age discrimination claim under Massachusetts law, after he was terminated for dishonesty for lying to Setra about completing a “channel partner toolkit”, finding that there was evidence that could cause a jury to conclude that an investigation into his dishonesty was biased and backfilled to hide discriminatory animus, and a younger employee involved in the same incident wasn’t terminated.
