A Tennessee federal district court denied HCA Management Services, LP’s motion for summary judgment on claims of gender and age discrimination under Title VII of the Civil Rights Act, the Age Discrimination in Employment Act, and the Tennessee Human Rights Act, and retaliation claims under these same statutes, brought by an age appropriate female case management compliance vice president, finding material disputes of fact as to whether the employer’s proffered reason of deficient performance for termination was pretext for discrimination, and finding there was sufficient evidence that the dismissal was retaliatory.
