A Pennsylvania federal court denied summary judgment to IT Landes Company, LLC on the Age Discrimination in Employment Act, the Americans with Disabilities Act and state law claims of a 59-year-old foreman with serious knee injuries that he was denied promotion to an open position and later selected for a RIF due to his age and disabilities, ruling that he presented enough comparator evidence to show age discrimination and evidence of disability discrimination animus from his supervisors.
