A Utah federal court partially denied Amazon’s motion to dismiss the claims of a 71-year-old Russian warehouse employee that he was discharged due to his age and national origin, in violation of the Age Discrimination in Employment Act and Title VII of the Civil Rights Act, ruling that while administrative remedies weren’t exhausted on his national origin claim, he sufficiently alleged that his age was a but-for cause of his termination, and that the safety violation Amazon cited was pretext.
