A federal district court in Georgia didn’t err in granting summary judgment to University Health Services, Inc. on a Black phlebotomist’s claim that she was fired because of her race, rather than for excessive tardiness. The Eleventh Circuit reasoned that she was tardy 32 times in the year leading up to her termination, she had received multiple warnings about her attendance issues, the health services didn’t give shifting reasons for her termination, and she didn’t show that she was treated less favorably than any non-Black phlebotomist under similar circumstances because her supervisor suspected that she had falsified her time records, ...
