The Tenth Circuit ruled that summary judgment was properly granted to Russell Stover Chocolates, LLC on a claim by an Hispanic machine operator that he was discharged because of his race and/or national origin, rather than because he engaged in inappropriate conduct towards female co-workers and had been discharged from the company, for the same behavior, when he previously worked for it. His allegedly biased supervisor had no role in the discharge decision, the court said, and he failed to show that Russell Stover did not honestly believe that he had engaged in sexually harassing conduct.
