A Texas federal district court denied without prejudice Niagara Bottling, LLC’s motion to compel arbitration in a case brought by a bisexual, HIV-positive former employee alleging harassment and discrimination based on race, disability, and sexual orientation under federal and state law, finding that the former employee’s sexual harassment allegations were insufficient to trigger the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act and that there was a genuine dispute about whether he had signed the arbitration agreement.
