A New Jersey federal court denied summary judgment to Washington Township Public Schools on the claims of an age-protected elementary school physical education teacher that he wasn’t hired for a middle school position due to his age, in violation of the Age Discrimination in Employment Act and state law, ruling that the PE teacher sufficiently showed he was qualified for the job, that a significantly younger person was hired, and that the proffered reasons for not hiring him were pretextual.
