The City of Huntsville is entitled to summary judgment on a firefighter’s claims of disability discrimination, failure to accommodate, and retaliation under the Americans with Disabilities Act and the Rehabilitation Act alleging he was fired after an incident at city hall in which he appeared intoxicated and behaved inappropriately, a Texas federal district court ruled. Although he proved that he had a qualified disability—based on undiagnosed gastrointestinal issues—he failed to demonstrate that his disability was a determining factor in the decision to terminate him, the court said.
