Dollar General is partially denied summary judgment on the California Fair Employment and Housing Act disability discrimination and retaliation claims of an employee with a job-related back injury who was terminated after his leave expired, where a reasonable jury could find that a doctor’s note stating he could return to work shows that he was qualified, the company didn’t engage in the interactive process, and the temporal proximity of his discharge supports retaliation, a federal court ruled.
