A Pennsylvania federal district court denied ProMedica’s motion to dismiss the claims of a consultant with immunodeficiency issues that she was refused a reasonable accommodation for her disability, and retaliated against for exercising her statutory rights, in violation of the Americans with Disabilities Act and the Family and Medical Leave Act, ruling that there was sufficient evidence to suggest that ProMedica is a successor in interest employer and liable under the statutes.
