A federal district court ruled that Barr-Nunn Transportation Inc. isn’t entitled to summary judgment on a resigned truck driver’s disability discrimination and retaliation claims under the Americans with Disabilities Act and Pennsylvania Human Relations Act. The driver, who was previously rehired after health issues including high blood pressure, bronchitis, and diabetes caused him to voluntarily resign, alleges that he wasn’t rehired after running out of medical leave and being issued a second voluntary resignation.
