Genuine issues of fact preclude summary judgment for Carbon Schuylkill Community Hospital, Inc. on a terminated skilled nursing account representative’s disability discrimination and failure to accommodate claims under the Americans with Disabilities Act, a federal district court in Pennsylvania ruled. The court acknowledged that the skilled nursing account representative, who sustained a right ankle injury which ultimately let to his leg being amputated, possessed the skill, experience or education necessary for the job.
