A Wisconsin federal district court partially granted HARIBO of America’s motion for sanctions, dismissing the Americans with Disabilities Act claims of a Black facility maintenance employee with an alleged psychiatric illness who claimed he needed accommodation for mental health issues when he was actually incarcerated during the relevant time period, finding that the maintenance employee couldn’t perform essential job functions while incarcerated and thus wasn’t a qualified individual with a disability, though his race discrimination claims under Title VII of the Civil Rights Act and 42 U.S.C. § 1981 remain pending.
