An Oregon federal court denied the Union Pacific Railroad’s motion for judgment as a matter of law against a railroad employee that he wasn’t permitted to return to work after rehabbing from a dislocated shoulder, in violation of the Americans with Disabilities Act and state law, ruling that the employee was a qualified individual under the statutes, and that the railroad’s screening policy for employees returning from injury didn’t account for an individual employee’s ability to perform.
