An Illinois federal court denied Essential Smoothies LLC’s motion to dismiss the claims of a female crew member 19 weeks pregnant allegedly offered a team member position then fired two days later due to her pregnancy, in violation of Title VII of the Civil Rights Act and the Pregnant Workers Fairness Act, ruling that the statutes apply to applicants as well as employees, and that she adequately pled that her sex and pregnancy directly led to her being let go after a job-shadowing session.
