A Louisiana federal district court denied a motion for summary judgment by Savard Labor & Marine, Inc. on the disability discrimination and retaliation claims under the Americans with Disabilities Act of a laid off branch manager diagnosed with a severe headache disorder, because the court couldn’t determine if she was actually disabled given the short duration of her medical condition, and she may be able to prove that Savard regarded her as disabled, and that her condition motivated her dismissal.
