A Texas Court of Appeals affirmed a trial court’s plea to the jurisdiction denial, and allowed a job applicant with amaxophobia, a fear of driving, to proceed on his state law claim that he was denied a police communications operator position at the University of Texas at El Paso for pretextual reasons, after he raised genuine issues of material fact regarding the university’s perception of him as impaired and alleged discrimination against him during a call with the background investigator.
