A New York federal district court granted summary judgment to the City of Yonkers on claims brought by an environmental maintenance worker with knee injuries for failure to provide reasonable accommodation and retaliation under the Americans with Disabilities Act, finding that the maintenance worker failed to demonstrate he could perform the essential functions of his job even with the requested accommodation of transfer to a street sweeper position, as manually lifting refuse was an essential function of the EMW position, and he failed to establish that he suffered an adverse employment action for his retaliation claim.
