A New York federal district court granted summary judgment to Consumer Reports on the claims of an acquisition agent with an anxiety disorder that he was denied a reasonable accommodation for his disability and subjected to retaliation for making the request, in violation of the Americans with Disabilities Act and state law, ruling that his proposed accommodation wouldn’t allow him to perform essential functions of the job, he didn’t suffer adverse action, and state law claims were dismissed.
