An Alabama federal district court denied the City of Birmingham’s motion to dismiss factual allegations in the Americans with Disabilities Act accommodation claim brought by a firefighter with anxiety, depression, and PTSD who alleged the city failed to transfer him from fire stations with high violent call volumes despite doctor’s notes, ruling that Rule 12(b)(6) does not permit dismissal of factual allegations and allowing the timely portions of the accommodation claim to proceed.
