Case: Disability Discrimination/Failure to Accommodate (E.D. Pa.)

A Pennsylvania federal court granted partial summary judgment to Patient First on the claims of a physician with back issues that he was refused accommodation for his disability, and discharged for making the request, in violation of the Americans with Disabilities Act, ruling that while Patient First had a legitimate nondiscriminatory reason for discharge, there were questions as to whether the requested accommodation was an undue hardship and whether the issue was discussed in good faith.
