A terminated chemical safety specialist’s allegations that the Arizona Board of Regents violated the Americans with Disabilities Act by failing to accommodate her Crohn’s disease could reasonably be expected to grow out of her EEOC charge alleging a continuing violation, a federal court ruled, where she had written a rebuttal letter to the EEOC referencing pretext for discrimination, and the record was insufficiently developed to determine the scope of the EEOC’s investigation.
