A Texas federal district court denied summary judgment to Bexar County, by and through its agent the Bexar County District Attorney’s Office, on disability discrimination claims and retaliation claims under the Americans with Disabilities Act, Rehabilitation Act, Family and Medical Leave Act, and Texas Labor Code brought by a word processing specialist with fibromyalgia who was terminated allegedly for a “no call, no show” absence, finding genuine issues of material fact regarding whether the incident actually happened, and whether the employer’s other stated reasons for the discharge were pretext for retaliatory actions.
