A Texas federal district court granted summary judgment to Wal-Mart on the claims of a detail cleaner with cardiac health issues that he faced discrimination and was discharged due to his disability, in violation of the Texas Commission on Human Rights Act, ruling that Wal-Mart provided sufficient evidence that the cleaner failed to utilize his alternative accommodation of applying for and obtaining a position that complied with his medical restrictions, which led to his discharge.
