A federal district court denied AIM Services, Inc. and its human resource director’s motion to dismiss the New York State Human Rights Law disability discrimination claim of a registered nurse who took leave to recover from a back injury and was later fired on a phone call with the director, where her discharge after requesting “some time to heal” was sufficient to plead discrimination, and the lack of clarity regarding her receipt of disability benefits wasn’t enough to dismiss the claim.
