A Pennsylvania federal district court denied summary judgment to Sam’s Club on Americans with Disabilities Act disability discrimination, retaliation, failure to accommodate, and Family Medical Leave Act retaliation and interference claims by a tire and battery technician with sickle-cell anemia who was terminated for alleged attendance policy violations, finding genuine disputes of material fact exist as to whether the termination was discriminatory or based on legitimate policy violations given the suspicious timing and evidence Sam’s Club may have considered FMLA-qualifying hospital absences as a part of the violation.
