North Homes, Inc. is entitled to summary judgment on a terminated mental health practitioner’s disability discrimination claims under the Americans with Disabilities Act and the Minnesota Human Rights Act, a Minnesota federal district court ruled. The court acknowledged that her exhaustion of leave and FMLA leave and her inability to perform the essential functions of the community-based position because of her brain condition, which caused dizziness, headaches and nausea, coupled with the negative feedback the employer received from an elementary school where she worked were legitimate, nondiscriminatory reasons for termination.
