A Pennsylvania federal court issued a monetary award against the city of Philadelphia on the claims of a police lieutenant with a brain injury that he was demoted due to his disability and faced retaliation for taking medical leave, in violation of the Americans with Disabilities Act, ruling that while the “same decision” defense applied to the discrimination charge, the remaining charges qualified the lieutenant for back pay of about $130,000, plus reinstatement as a provisional captain.
