Caregiving Company Gets Transgender Worker’s Bias Case Trimmed

A health and home care company defeated a transgender former employee’s discrimination, whistleblower, and wrongful discharge claims, but the worker can pursue her retaliation allegations, a federal judge said.

The ex-employee didn’t sufficiently allege CareGivers America LLC treated cisgender coworkers better than her or otherwise link her firing and gender identity, the US District Court for the Middle District of Pennsylvania said. But she plausibly suggested she lost her job as retaliation for making internal discrimination complaints, the opinion said.
