A Capital One subsidiary failed to end a lawsuit alleging it misclassified some employees as overtime exempt when a federal judge ruled the workers’ claims are sufficient to move forward.
Two former Capital One Services LLC employees adequately alleged that they typically worked more than 40 hours per week without overtime pay and that the company knew or should have known about their extra hours, the US District Court for the Eastern District of Virginia said. It’s too early for Capital One to challenge their ability to pursue class and collective claims, the opinion added.
