Capital One Accused of Pregnancy, Disability, and Age Bias

A Capital One branch manager in New York refused to accommodate a relationship banker’s pregnancy-related medical restrictions and otherwise discriminated against her based on her sex, disability, and age, a federal lawsuit alleges.

The court complaint filed by K. Ann O’Hagan March 24 under New York state law includes rare allegations of intersectional discrimination based on pregnancy and age. O’Hagan, who was 44 years old at the time, says her boss Cynthia Cusati told her it was impossible that O’Hagan could be pregnant at her age.
