Canadian National Railway Defeats Employee’s Retaliation Suit

Canadian National Railway defeated an employee’s retaliation lawsuit, after the Seventh Circuit said Wednesday that the employee failed to provide enough evidence that the company retaliated against him because he testified in his brother’s lawsuit against it.

Nazariy Lesiv repaired railcars alongside his brother Lyubomir for Canadian National. Lyubomir filed a lawsuit against the company in 2017, alleging employment discrimination based on national origin, perceived sexual orientation, and race as well as retaliation.
