California DA Beats Deputy’s Speech Retaliation Suit Over Op-Ed

Santa Clara County District Attorney Jeffrey Rosen defeated a free speech retaliation claim he faced from a former California deputy district attorney who was transferred to less-prestigious courts after he published an op-ed about racism.

Daniel Chung’s retaliation claim is precluded because it was already litigated and determined as part of the administrative grievance procedure and arbitration, the US District Court for the Northern District of California ruled Thursday.
