Former bus drivers for a trio of transportation companies again lost their bid to obtain preliminary court approval for a $3.5 million class settlement to resolve their long-running lawsuit over allegedly unlawful wage and hour practices.
The workers didn’t rectify several issues identified in prior orders rejecting their bids for class certification and settlement approval, including a failure to demonstrate that liability could be proven on a class-wide basis through the existence of unofficial companywide policies, Judge Jon S. Tigar of the US District Court for the Northern District of California said in a Tuesday order.
