Bojangles Managers’ Wage Classes Too Broad, Overturned on Appeal

Bojangles’ Restaurants Inc. shift managers must try again to win permission to pursue wage-and-hour claims as a group after the company convinced an appellate panel Tuesday that their classes were too broad.

The shift managers allege the fried chicken chain made them work off the clock and sometimes edited records to avoid overtime, and they convinced the trial judge to sign off on class treatment for workers in two states. But the district court “employed an inappropriately high level of generality” when it certified those classes, the US Court of Appeals for the Fourth Circuit said.
