Boeing Win Upheld Over Worker Suspected of Dodging Drug Test

A former Boeing Co. machinist who said his termination for failing to complete a drug screening violated federal disability discrimination and other laws failed to support his claims, the Ninth Circuit ruled Friday.

Michael Kelly was working under a “last chance agreement” at the time, the court said. It subjected him to three years of unannounced testing and provided that he could be fired if he tampered with, otherwise tried to invalidate, or refused to cooperate with a test, the court said.
