A former Bluemercury Inc. sales associate failed to sufficiently allege that his retail job involved the required amount of manual labor, dooming for now claims that the company should have made weekly wage payments.
The ex-employee’s stocking, merchandise organizing, and other duties constitute physical labor, but he didn’t provide enough details about how much of his time those tasks took up compared with other work assignments such as sales, so he’ll need to add more information in an amended complaint, the US District Court for the Southern District of New York said Thursday.
