A BlueCross BlueShield pharmacist could convince a jury she was fired for seeking accommodation for her mental health issues, the Eastern District of Tennessee ruled.
Daren Kathryn Eddy is therefore entitled to a trial on her Americans with Disabilities Act retaliation claim, the court said.
BlueCross BlueShield of Tennessee Inc. was aware of Eddy’s request because she kept the company “well informed of her progress in completing ADA accommodation application forms” she received from the company, including related medical visits, the court said.
