A Black worker who accuses clean energy company Momentum Solar of systemic race bias can support his class action by continuing to point to a separate class lawsuit in Brooklyn, an unnamed co-worker’s experience, and the company’s growth and success, the District of New Jersey ruled.
Mark Venson sued Pro Custom Solar LLC, which does business as Momentum, and certain executives in October 2019 under 42 U.S.C. §1981 and New Jersey’s Law Against Discrimination, seeking to represent both himself and similarly situated Black employees.
