Black Ex-DOJ Program Specialist Advances Some Retaliation Claims

A Black former program operations specialist plausibly alleged Justice Department supervisors retaliated after she refused to rescind a race bias complaint, but she failed to exhaust some claims against the agency, a federal judge said.

The worker sufficiently linked her disproportionate workload, leave denial, and placement on a performance improvement plan to her rejecting a supervisor’s request to pull back the discrimination complaint, but she waited too long to internally raise her other retaliation allegations, the US District Court for the District of Columbia said Monday.
