BJ’s Wholesale Employees Drop Age Discrimination Lawsuit (1)

Three Maryland employees of BJ’s Wholesale Club Inc. who recently filed a potential collective action alleging age discrimination have voluntarily dismissed their claims, they told a federal court in the state.

The workers have to arbitrate their claims, according to James M. Ray II, an attorney for the plaintiffs. “The employees signed mandatory arbitration agreements and conflict/class waivers back in 2013 that were not apparent until we filed suit,” he told Bloomberg Law in an email. “We are preparing to re-file in arbitration.”
