A national trade association is asking a Texas-based court to toss out a Biden administration rule aimed at raising wages for workers on federal construction projects, alleging it was issued by “improperly appointed” Acting Labor Secretary Julie Su.
The Associated Builders and Contractors’ lawsuit marks one of the first official legal challenges alleging that Su doesn’t have the authority to sign off on US Labor Department regulations.
