Biden’s New Shot at Joint Employer Liability Nears Release

The U.S. Labor Department’s new approach to joint employment liability was approved by the White House regulatory review office, signaling the proposal’s imminent release.

Clearance from the Office of Information and Regulatory Affairs, which was announced on the agency’s website Friday, came only nine days after DOL first submitted the measure. That’s a faster turnaround than is typical for OIRA.

The proposed rule could potentially seek public comments on whether to repeal the Trump administration’s regulation.
